Your Federation

Tuesday, December 25, 2018 and Tuesday, January 1, 2019 are statutory holidays and holidays provided for in the Act respecting labor standards. For each general holiday, the employer must pay the employee an indemnity equal to 1/20 of the wages earned during the four complete weeks of pay preceding the week of the holiday.

However, your school bus drivers are not entitled to these leave payments because they are laid off on or about December 21, 2018 until January 4, 2019 or later. However, a collective agreement may contain specific provisions that a driver is entitled to these leaves. If a driver is required to work on December 25, 2018 or January 1, 2019, the employer must, in addition to paying him the salary corresponding to the work done, pay the driver the allowance provided for in paragraph 2 above or grant him leave of absence. compensatory one day. This leave must be taken within three weeks before or after that day, unless a collective agreement provides for a longer period. Only employees who are expected to work on December 24 or 26, 2018 are entitled to payment of the Christmas leave and only those who are called to work on December 31, 2018 or January 2, 2019 may benefit from the payment of the New Year holiday.
